Go.Bright.Blue Subscription Terms & Conditions
Welcome to the terms and conditions of use (“Terms”) for our Subscription ordering program.
IMPORTANT NOTICE – PLEASE READ CAREFULLY
These Terms govern your participation in subscription-based services (“Subscription Products”) through the Go.Bright.Blue (the “Platform”). These Terms are between you and Bright.Blue UK Limited and/or its affiliates, or between you and a Marketplace Seller participating in Go.Bright.Blue’s Subscription Services (a Third-Party Seller) as appropriate. Please note that your use of Go.Bright.Blue is also governed by our General Terms and Conditions, our Privacy Policy, as well as other applicable terms, conditions, limitations, and requirements (including Third-Party Seller terms, conditions, limitation and requirements that may apply), in each case as made be modified from time to time, all of which are incorporated into these Terms by reference. In the event of conflict, these Terms prevails for matters relating to Subscriptions.
By enrolling in a Subscription, you confirm that you (i) have read and understood these Terms, (ii) are at least 18 years old and legally capable of entering into binding contracts, and (iii) reside in the United Kingdom or the European Union. If any part of these Terms is unclear, please contact us before subscribing.
1. Definitions
“Subscription” means an arrangement whereby we automatically supply and bill you for Subscription Products at the frequency and price agreed at checkout (e.g. weekly, monthly).
“Subscription Order” means each individual order generated under your Subscription.
“Subscription Confirmation” has the meaning given in section 4. “Coupon” (or “Voucher”) means an electronic code or other token that can be redeemed for partial or full payment for specified goods, services, or digital content.
Other capitalised terms have the meanings given in the Terms.
2. Compliance Framework
These Terms has been drafted to comply with, and should be interpreted in accordance with, the following key legislation and guidance (as amended):

Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“CCR 2013”);

Consumer Rights Act 2015;

Payment Services Regulations 2017 and UK GDPR/PECR in relation to payment and data;

Guidance of the Competition & Markets Authority on auto-renewing subscriptions (January 2023);

UK CAP Code (ASA) for advertising;

Value Added Tax Act 1994 Sch 10A (single & multi-purpose vouchers);

DMCC Act 2024 (Royal Assent May 2024);

Digital Content & Digital Services Directives (EU 2019/770 & 2022/2065);

Advertising claims comply with CAP Code rules, 3, 8, and 22 (for subscriptions);

EU Omnibus Directive 2019/2161 (for EU consumers); and
-
any other mandatory consumer-protection or e-commerce rules in the territory of delivery.
Nothing in these Terms limits your statutory rights.
3. Eligibility & Scope
3.1 Subscriptions are available only to consumers aged 18 or over, residing in the UK or EU and having a Go.Bright.Blue account with a valid payment method.
3.2 We currently deliver physical products only within the UK. Digital content may be supplied EU-wide unless prohibited by local law.
3.3 Certain products (e.g. age-restricted items) may be excluded from Subscriptions or subject to additional verification steps. 3.4 Subscriptions that deliver Coupons are available EU-wide. Physical delivery is not applicable; Coupons are supplied as digital content.
4. Formation of Contract
4.1 Immediately before you click “Pay Now & Start Subscription”, we display key information summary containing information required by DMCC Act and Schedule 2 CCR 2013. This forms part of these Terms. After you submit, we will send you an email acknowledging receipt. Your offer is accepted, and a contract formed, only when we send a subsequent “Subscription Confirmation” email that specifies product(s), price, frequency, next charge date and estimated delivery.
4.2 Each Subscription Order constitutes a separate sales contract that incorporates these Terms, the Terms and any product-specific conditions.
5. Pricing, Payment & Billing
5.1 Prices include VAT (where applicable) and are shown at checkout.
5.2 For each Subscription Order, we will charge your chosen payment method on the day your order is processed (“Billing Date”). You authorise us (and our payment processor) to store your card and take recurring payments using Strong Customer Authentication, where required.
5.3 If payment fails, we will email you and retry once. If unsuccessful your Subscription will be paused; no further orders will be processed until a valid payment method is added.
5.4 Price changes: If the price of a Subscription Product increases by more than 5% we will give you at least 30 days’ notice. You may cancel (see section 9) before the change takes effect. Promotional or limited-time discounts apply only while advertised. 5.5 Where you purchase a Coupon that qualifies as a single-purpose voucher for VAT purposes, VAT is accounted for at the date of issue. For multi-purpose vouchers, VAT is due on redemption. Prices displayed include any VAT due.
6. Renewals & Pre-Charge Notifications
6.1 Subscription(s) continue until cancelled (section 9).
6.2 We will send you a reminder at least 3 days before each Billing Date, specifying the amount due, items, delivery date and how to cancel or amend. For digital content, this reminder is sent before access/ download is enabled.
6.3 You must keep your contact and payment details up to date. Notifications sent to the email address in your account are deemed received on dispatch.
7. Delivery of Physical Products
7.1 We aim to dispatch Subscription Orders on or about the date shown in your Subscription Confirmation. Delivery times are estimates.
7.2 Title and risk in physical goods pass on delivery. If an item is unavailable, we or a Third-Party Seller will notify you and (i) offer a suitable substitute, or (ii) skip that delivery and adjust the price accordingly.
7.3 If delivery is delayed beyond 30 days without your consent you may cancel the relevant Subscription Order for a full refund.
8. Supply of Digital Content
8.1 Digital content is made available via your Go.Bright.Blue account or delivered to the email address on file.
8.2 By choosing immediate access you request and acknowledge that (i) supply will begin before the end of the CCR 2013 14-day withdrawal period, and (ii) you therefore lose the right to withdraw once download starts.
8.3 Digital licences are non-transferable and subject to any additional end-user licence terms shown at purchase. 8.4 Coupon-specific Terms: Coupons have no cash value and are non-transferable unless expressly stated. Lost or stolen Coupons will not be replaced unless required by law. Coupons cannot be used to buy other coupons or exchanged for cash. 8.5 If any digital content supplied under your Subscription does not conform with these Terms or the statutory standards of satisfactory quality, fitness for purpose and description, you may require us, at no extra cost, to bring the content into conformity within a reasonable time and without significant inconvenience. Where this is impossible or disproportionately difficult, or we fail to do so in a reasonable time, you are entitled to an appropriate price reduction or a full refund, as provided by the Consumer Rights Act 2015 (UK) and Directive (EU) 2019/770.
9. Your Right to Cancel, Withdraw or Return
9.1 Cooling-off period: You may cancel a Subscription Order for physical goods within 14 days after delivery without giving a reason. To exercise this right, you must inform us (see Annex 1) and return the goods within 14 days. You bear the cost of return, except for faulty or mis-described items.
9.2 Ongoing cancellation: You may cancel or pause a Subscription at any time through “My Subscriptions” in your Settings or by contacting us. Cancellation will take effect:
(a) For physical goods – if requested before the cut-off shown in your reminder email no further charges will apply; otherwise, cancellation is effective from the next cycle. (b) Cancellations will not affect orders for which you have already received dispatch confirmation. You will only be charged for the order dispatched and no further orders will be placed. (c) For digital content (including Coupons) – if the content has not been accessed, downloaded, activated, or linked to your account, cancellation takes effect immediately and no further charge will apply; once any of these actions has occurred, you cannot cancel that order, and no refund will be provided. (d) Cancellations can be completed in no more than two clicks; you will receive an email confirmation within 24 hours.
9.3 Returns & refunds follow our Returns Policy; consumers retain their statutory rights against the Seller for defective goods/digital content.
10. Modifying Subscriptions
You may change delivery frequency, quantity, next delivery date, payment method or shipping address at any time via your account dashboard, subject to the cut-off in section 9.2(a). We reserve the right to reject changes for operational reasons.
11. Changes to Products, Services or these Terms
We may update or discontinue Subscription Products, or amend these Terms, to reflect legal, regulatory or business changes. Material changes will be notified at least 30 days in advance and will not affect orders already confirmed. If a Coupon is withdrawn before the stated expiry date, we will either honour outstanding Coupons or refund the purchase price. If you object to a change, you may cancel as per section 9.
12. Account Security & Fraud
You are responsible for maintaining the confidentiality of your login credentials and payment details. Suspected fraudulent or abusive behaviour may result in immediate cancellation of your Subscription.
13. Data Protection
Processing of personal data under these Terms is described in our Privacy & Cookie Policy. Key points:
• Legal basis: contract performance (Art 6 (1)(b) UK GDPR) and legitimate interests (e.g. fraud prevention).
• Payment data is processed by PCI DSS compliant processor(s) located in the UK/EU.
• You have the right to access, rectify, erase and port your data; contact privacy@bright.blue.
14. Limitation of Liability
Without prejudice to the limitation of liability provision set out in our General Terms and Conditions or any applicable Third-Party Seller terms, and to the maximum extent allowed by applicable law, our and any Third-Party Seller’s aggregate liability to you will not exceed the amount paid by you for Subscription Orders in the twelve months preceding the claim. Nothing in these Terms limits or excludes your statutory rights as consumer or our and any Third-Party Seller’s responsibility for death or personal injury caused by negligence, fraud or any liability that cannot legally be limited.
15. Complaints & Dispute Resolution
15.1 We hope to resolve any complaints quickly. Please contact us using the details in section 17.
15.2 If you are unhappy with our response, you may refer disputes to RetailADR (www.retailadr.org.uk) or, if you are an EU consumer, to the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr). Participation in ADR is voluntary unless required by law.
16. Governing Law & Jurisdiction
These Terms and any dispute arising from it are governed by English law. The courts of England & Wales have non-exclusive jurisdiction, except that consumers resident in the EU may bring proceedings in their local courts.
